Los datos personales que InsightOut SL, con CIF B-66684838 y domicilio en Calle Via Augusta 9 Entlo 1ª 08006 Barcelona, (en adelante “la empresa”) recoge mediante este formulario de contacto acerca del usuario (en adelante “Candidato”), incluyen, entre otros, la siguiente información: Su nombre, edad, datos de contacto, imagen y cualquier otro tipo de información que pueda haber incluido.

Aceptando estas condiciones de privacidad al marcar la casilla "He leído y acepto los términos y condiciones" en el momento de su inscripción, el Candidato otorga a la empresa su consentimiento para almacenar y tratar sus datos personales de acuerdo con la Ley Orgánica 15/1999 de 13 de diciembre de Protección de Datos de Carácter Personal y el RD 1720/2007 de 21 de diciembre, quedando incorporados en los ficheros creados al efecto y mantenidos bajo la responsabilidad de dicha compañía de conformidad con las disposiciones establecidas. Estos datos son recabados para servir con exclusividad a los fines solicitados.

El casting es ofrecido por InsightOut SL para cubrir la demanda de modelos y actores/actrices en el desarrollo de producciones y trabajos solicitados por clientes de la empresa.

1. REQUISITOS DE INSCRIPCIÓN

Su inscripción debe cumplir necesariamente con las siguientes normas:

(a) No debe ser obsceno, ofensivo o pornográfico.

(b) Debe ser una imagen fiel y exacta.

(c) No debe utilizar material de otra persona o contenido que violaría los derechos de terceros.

(d) La solicitante debe tener plena capacidad legal y/o en su defecto, el consentimiento de sus padres o tutores.

(e) No debe contener la imagen y/u otros datos personales de cualquier otra persona.

(ii) Cualquier solicitud que no cumpla con requisitos de inscripción será automáticamente excluida.

2. MENORES DE EDAD

Los menores de edad no podrán usar los servicios disponibles a través de la Web sin la previa autorización expresa de sus padres, tutores o representantes legales, quienes serán los únicos responsables de todos los actos realizados a través de la Web por los menores a su cargo, incluyendo la cumplimentación de los formularios con los datos personales de dichos menores.

3. PROPIEDAD INTELECTUAL

La participación en el casting conlleva la cesión de los derechos de imagen de los participantes a la empresa durante su desarrollo. Por dicha razón, la empresa, podrá utilizar su presentación en cualquier medio de comunicación incluyendo (sin limitación) cualquier tipo de aplicación, la web y todo ello para los fines de su promoción, pudiendo hacer por cuenta propia o mediante su cesión o licencia a terceros.

4. EL USO DE SUS DATOS PERSONALES

Los datos personales facilitados para participar en el “casting” resultan imprescindibles para las finalidades que se persiguen. Estos datos incluirán cualquier información sobre los participantes que sean personalmente identificables, incluyendo, sin limitación, su nombre, fecha de nacimiento, dirección de correo electrónico, dirección, país de residencia, imágenes y otra información con la que pueda ser identificado. Estos datos, están bajo la protección de la Normativa Comunitaria y Nacional al respecto, por lo que de acuerdo también con la política de privacidad de la empresa, estos datos sólo podrán ser utilizados de acuerdo con los siguientes términos y condiciones, y a los cuales presta expresamente su consentimiento:

(a) a participar en los castings requeridos para llevar a cabo los trabajos de producción y rodajes desarrollados por la propia empresa o subcontratados por ésta.

(b) A que la empresa empresa pueda ponerse en contacto con el Candidato que resulte ser seleccionado para un casting mediante los datos de contacto facilitados a tal efecto.

(c) para formar parte de la selección del candidato adecuado a las características requeridas para cada trabajo y atendiendo a las disposiciones del cliente.

(d) A que la empresa pueda evaluar con el cliente final la información proporcionada por el Candidato a efectos de seleccionar y elegir el candidato más adecuado atendiendo a las necesidades y requisitos perseguidos por el cliente a tal fin.

(e)También para proporcionar información en respuesta a cualquier solicitud de cualquier autoridad judicial o administrativa; y para en su caso compartirla con otras empresas del grupo corporativo o con licenciatarios en los distintos territorios, o con empresas legalmente reconocidas a quienes hayamos subcontratado las funciones de recogida de datos. Todos los datos recogidos se almacenan en un servidor seguro.

En la recogida y el tratamiento de los datos de carácter personal se han adoptado las medidas de seguridad adecuadas para evitar la pérdida, el acceso no autorizado o la manipulación de los mismos, de acuerdo con lo establecido en el Real Decreto 1720/2007, de 21 de diciembre.

Los participantes en el Casting, podrán en todo momento, ejercitar los derechos de acceso, rectificación, cancelación u oposición sobre sus datos personales así como el de revocación del consentimiento para cualquiera de las finalidades señaladas, enviando comunicación fidedigna a InsightOut SL mediante un email a admin@insightout.studio.

5. LEY APLICABLE Y JURISDICCIÓN

Estos términos y condiciones se regirán por las leyes de España y están sujetos a la jurisdicción no exclusiva de los tribunales de Barcelona (España).

Your registration must necessarily comply with the following rules:

(c) You must not use someone else's image or content or in any way violate the rights of third parties.

(d) The applicant must have full legal capacity and/or failing that, the consent of their parents or guardians.

(e) It must not contain the image and/or other personal data of any other person.

(ii) Any application that does not meet the registration requirements will be automatically excluded.

2. MINORS

Minors may not apply for this casting without the express prior authorization of their parents, guardians, or legal representatives, who will be solely responsible for all acts carried out through the Web by minors in their charge, including filling in the forms with the minor's personal data.

3. INTELLECTUAL PROPERTY

Participation in the casting entails the transfer of the participants’ image rights to the Company during its development. For this reason, the company may use its presentation in any means of communication including (without limitation) any type of application and on the web, for the purposes of its promotion, being able to do it on its own account or through its assignment or license to third parties.

4. PERSONAL DATA USES

The personal data provided to the Company are necessary for the purposes pursued. This data will include information about the participants that is personally identifiable, including, and not limited to, their name, date of birth, email address, address, country of residence, images and other information with which they can be identified. These data are under the protection of the Community and National Regulations, so in accordance with the Company privacy policy, these data may only be used in accordance with the following terms and conditions, and to which it provides expressly your consent:

(a) to participate in the required Castings, in order to develop audiovisual productions and filming work by the company itself or subcontracted by it.

(b) to authorize the Company to get in contact with the selected Candidate, using the contact information provided for this purpose.

(c) to be part of the selection of the appropriate candidate, according to the required characteristics for each job and following the client's dispositions.

(d) to evaluate Candidates with the final customer in order to select and choose the most appropriate candidate, assessing needs and requirements pursued by the client.

(e) to provide information in response to any judicial or administrative authority request; and to share it with other companies of the corporate group or with licensees in the different territories, or with legally recognized companies to whom we have subcontracted the data collection functions. All collected data is maintained on a secure server.

In the collection and processing of personal data, appropriate security measures have been adopted to prevent loss, unauthorized access or manipulation thereof, in accordance with the provisions of Royal Decree 1720 / 2007, of December 21.

The participants in the Casting may, at any time, exercise the rights of access, rectification, cancellation or opposition to their personal data as well as the revocation of consent for any of the purposes indicated, by sending reliable communication to InsightOut SL through an email to admin@insightout.studio.

5. LAW AND JURISDICTION

These terms and conditions will be governed by Spanish law and are subject to the non-exclusive jurisdiction of the courts of Barcelona (Spain).
